Why a betting withdrawal shows pending or fails

A withdrawal usually stays pending because the operator is running checks the law requires (age, identity, self-exclusion), because the amount falls in a higher payment tier, or because the wallet cannot take it. A monetary prize must be credited within two days (Act s.70(1)); winnings unpaid after 14 days bring a penalty (regulation 104).

Pending, failed and late are different states

A withdrawal shown as pending means the operator has not yet released the money from your player account. A failed withdrawal means the money was released or attempted and did not arrive. A late payment is one that has passed the time the law allows. Each has different causes, so the first job is to work out which one you have. Under section 69 of the Act, an online gambling transaction starts when you deposit into your gaming account and concludes when you withdraw from it. Withdrawal is therefore the closing step, and it is the step where the operator has most to verify.

Checks the operator must run first

A pending status after a win is often the operator doing what the law requires. Section 70(6) says an operator shall require proof of age of majority before remitting a prize to the registered player. Regulation 85(3) requires the identity of any winner to be verified before winnings are paid, and regulation 85(4) says this includes official identification documents and confirmation that you are not self-excluded and are legally eligible to gamble.

The time limits that apply

Section 70(1) requires a licensee to credit a monetary prize to your account within two days. Regulation 88(2) then requires payments to follow the payment schedule in the Third Schedule, which sets a channel, checks and a time by prize size. The tier amounts and their times are tabulated in the timelines guide, so check them there rather than from memory.

Regulation 24(1) adds that a licensee shall settle winning bets promptly and in accordance with its published rules. Those rules are therefore worth reading when a delay is unexplained.

Regulation 86 adds a limit on where money can go: anonymous gambling and the use of virtual assets for gambling or withdrawal are strictly prohibited unless the Authority approves them in consultation with the National Treasury. A withdrawal request to an address or account that is not clearly yours is therefore likely to be refused or held for review.

Money that arrives smaller

Section 75 allows a licensee to pay bank charges for deposits received and funds withdrawn, and otherwise only to debit wagers you direct or remit funds at your request. What to do while a withdrawal is pending

  1. Read the status message and the operator's rules

    Note whether it asks for a document, names a tier, or gives an error from the wallet. The cause decides the next step.

  2. Supply what is asked, once, through the official channel

    Upload documents inside your account or to the contact details shown there. A message asking for your PIN or a "release fee" is not a verification step, and the guide on protecting an account from SIM swap covers the phone line side.

  3. Keep the records

    Save the bet reference, the date the result was declared, the withdrawal request time and every message. Section 76(1) requires the licensee to keep a register of all monies paid out, so a record exists on its side as well.

  4. Escalate in order

    Contact customer care first. Section 68(8) requires an online operator to maintain a customer care centre within Kenya, and regulation 103 requires an approved internal dispute resolution mechanism.

When 14 days have passed

A licensee that fails to pay winnings to a player within 14 days is liable to a penalty of 5% of the total winnings, payable to the Authority. It must still pay the player the outstanding amount plus interest at 5% per day from the lapse of 14 days for the next 21 days until payment in full. Non-compliance may lead to suspension of the licence.

Illustrative example: winnings of KES 20,000 left unpaid after 14 days. The penalty is 5% of the total winnings: 20,000 x 0.05 = KES 1,000, payable to the Authority, not to the player. The player remains owed the KES 20,000 outstanding plus the interest the regulation describes.

Questions and answers

How long can a withdrawal stay pending?

The sources read give no single pending period for every withdrawal. Section 70(1) of the Act sets two days to credit a monetary prize to the player's account, the Third Schedule sets time limits by prize tier, and regulation 104 attaches a penalty when winnings are unpaid after 14 days.

Why am I asked for my ID when I withdraw?

Section 70(6) of the Act requires proof of age of majority before a prize is remitted, and regulation 85(3) requires the licensee to verify the identity of any winner before paying winnings.

Can the operator cancel winnings?

Only in limited cases the regulations name. Regulation 74 requires a licensee to cancel winnings obtained in breach of a self-exclusion. Section 75 of the Act otherwise limits what a licensee may do with the money in your account.

Can I withdraw to someone else's M-Pesa number?

The Third Schedule refers to the player's registered mobile money wallet, and regulation 85 requires identity verification. Use a wallet registered in your own name so the details match the account.

What happens if the operator has not paid after 14 days?

Regulation 104 makes the licensee liable to a penalty of 5% of the total winnings, payable to the Authority. It must still pay the player the outstanding winnings plus interest at 5% per day from the lapse of 14 days for the next 21 days, and the licence may be suspended.
