Can a betting company hold your winnings until you verify?

Yes, for the checks the law requires. The Act requires proof of age before a prize is remitted (s.70(6)) and the regulations require the winner's identity to be verified before payment (r.85(3)). No source read allows an open-ended hold: the Third Schedule sets payment times by tier, and r.104 penalises winnings unpaid after 14 days.

The short answer: a check is allowed, an open-ended hold is not

A licensed operator may pause a payout while it completes the verification the law requires. It may not treat that pause as a way of keeping the money. The rules that apply sit in two places: the Gambling Control Act, 2025 and the Conduct of Gambling Operations Regulations, 2026.

This guide separates three things that are often mixed up: a legal verification step, a payment time that the Third Schedule sets, and a hold that has no basis in the sources. The general causes of a stalled payout are in the guide on why a betting withdrawal is pending or failed.

What the law requires before winnings are paid

RequirementProvisionEffect on a payout
Proof of age of majority before a prize is remittedAct s.70(6)A payout can wait for age evidence
Identity of any winner verified before winnings are paidOps Regs r.85(3)A payout can wait for an identity check
Verification includes official identification documents, and confirms the person is not self-excluded and is legally eligibleOps Regs r.85(4)The operator may ask for a document and consult the self-exclusion register
Know-your-customer verification of all punters under the Proceeds of Crime and Anti-Money Laundering ActOps Regs r.98(2)An anti-money laundering review can add to the checks
No prize paid without verification of lawful ticket ownershipThird Schedule, General Provisions (a)The operator must be satisfied the win is the account holder's

Each row is a duty placed on the operator. Skipping the check to pay faster would put the operator in breach, which is why a request for documents at withdrawal is normal rather than a sign of bad faith.

Where the time limits are, and where they are not

Section 70(1) says that when a player wins a monetary prize in an online gambling transaction, the licensee must credit the amount to the player's account within two days. Regulation 88(2) then requires punters' payments to follow the Third Schedule. The schedule sets the checks and the payment time for each tier, as summarised below.

Prize tier (Third Schedule)Checks listedPayment time stated
Small: up to KES 500,000Basic identity verificationCompleted immediately
Mid: KES 500,001 to KES 5,000,000Government-issued identification, ticket ownership verification, basic anti-money laundering checksWithin five working days
Large: above KES 5,000,000 up to KES 50,000,000Full identity verification, ticket authentication, enhanced anti-money laundering checks; in-person or secure video verification where necessaryWithin fourteen working days after completion of verification
Jackpot: above KES 50,000,000Financial counselling and secure payment arrangements offeredWithin thirty working days after completion of verification

Notice how the clock is worded. The small and mid tiers state a time for the payment itself. The large and jackpot tiers run from "completion of verification", so the schedule counts a period after the checks, not a limit on the checks. The sources read do not say how long the checks themselves may take, and this guide does not invent a figure. The full tier detail is in the guide on prize payment and withdrawal timelines.

Illustrative example: a prize of KES 600,000. It is above KES 500,000 and below KES 5,000,000, so it falls in the mid tier. The schedule requires government-issued identification, ticket ownership verification and basic anti-money laundering checks, and payment within five working days. The text does not say whether those five days run from the win or from the end of the checks, so a player should ask the operator which it applies.

What a hold cannot lawfully turn into

Section 75 limits what a licensee may do with money standing to the credit of a player's account. It may debit a wager made by the player or directed by the player, remit funds at the player's request, and pay bank charges for deposits received and funds withdrawn. Nothing in that list allows the operator to keep a verified player's balance because a check is taking long.

Section 76(2) adds that the money in player accounts, including money in transit, must at any time be at least equal to the total standing to the credit of players' accounts. That is a safeguard on the operator's side. It does not decide when a particular withdrawal must arrive.

Cases where winnings are lawfully withheld or cancelled

There is one case in the regulations where winnings do not reach the player at all. Regulation 74 deals with self-exclusion: a licensee that accepts a wager from a self-excluded person must refund all stakes, and the winnings are forfeited to the Authority. The licensee is also required to cancel any winnings obtained in contravention of the exclusion.

Regulation 86 is a separate limit on method: anonymous gambling and the use of virtual assets for gambling or withdrawal are prohibited unless the Authority approves them in consultation with the National Treasury. A request to withdraw to an address that is not clearly yours can therefore be refused.

What to do when a payout is held for verification

  1. Ask which item is outstanding

Ask customer care to name the exact check: age, identity, ticket ownership or an anti-money laundering review. Section 68(8) requires an online operator to keep a customer care centre in Kenya to respond to issues raised by consumers.

  2. Send documents only through the operator's own channel

Use the account or the contact details shown inside it. A message that asks for your PIN, or for a fee to release winnings, is not a verification step. The guide on proof of age and identity checks explains what an operator may legitimately compare.

  3. Fix mismatches at the source

If your account name differs from your identity document, correct it through the operator. The guide on a name that does not match the ID or SIM covers the usual causes.

  4. Keep dates and messages

Record the date the result was declared, the withdrawal request time, the date you supplied each document and every reply. These dates matter if the 14-day rule is later in question.

  5. Read the published rules

Regulation 23(1) requires a licensee to display the rules and terms applicable to each bet, and regulation 24(1) requires winning bets to be settled promptly and in accordance with the published rules.

If the payment is still not made

A licensee that fails to pay winnings to a player within 14 days is liable to a penalty of 5% of the total winnings, payable to the Authority. It must still pay the player the outstanding winnings plus interest at 5% per day from the lapse of 14 days for the next 21 days until payment in full. Non-compliance may lead to suspension of the licence.

Illustrative example: winnings of KES 30,000 unpaid after 14 days. The penalty is 5% of the total winnings: 30,000 x 0.05 = KES 1,500, payable to the Authority and not to the player. The player stays owed the KES 30,000. The regulation does not state the base on which the daily interest is charged, so it is not computed here.

The regulations do not say whether a pending verification pauses the 14 days. Because of that gap, the safest reading for a player is to supply what is asked promptly and keep the dates. Disputes over settlement go through the dispute resolution procedure the Authority has approved (r.24(2), r.103). Tax deductions on a payout are a separate matter, set out in the guide on how the 20 percent tax shows on a payout.

The regulator's toll-free line is 0800-723-770. Verification is a legal gate for adults only. Gambling is addictive: play responsibly, and do not stake more to chase a delayed payment.

Questions and answers

Is it legal for an operator to refuse to pay until I send my ID?

Verification before payment is a legal duty, not a favour. Section 70(6) of the Act requires proof of age of majority before a prize is remitted to the registered player, and regulation 85(3) requires the winner's identity to be verified before winnings are paid.

How long can the hold last?

The sources read give no single figure for a verification hold. They give payment times by prize tier in the Third Schedule, a two-day credit rule for monetary prizes in section 70(1), and a penalty under regulation 104 when winnings are unpaid after 14 days.

Can the operator use my balance for something else while it checks me?

Section 75 of the Act lists the only things a licensee may do with money standing to the credit of a player's account: debit wagers, remit funds at the player's request, and pay bank charges for deposits and withdrawals.

Does the operator have to tell me what it needs?

The sources read do not prescribe a notice. Regulation 23(1) requires a licensee to display the rules and terms applicable to each bet, and section 72(6) requires it to make all rules for its games available to the player, so the verification steps should be findable there.

What if the verification fails because my details do not match?

The operator cannot pay a winner it cannot verify, and section 72(5) requires it to cancel a registration made with false information. If the mismatch is an honest error, ask customer care which item is outstanding and correct it through the operator's process.

Where do I complain about a hold that seems too long?

Begin with the operator's customer care centre, which section 68(8) requires within Kenya. Regulation 103 requires an internal dispute resolution mechanism approved by the Authority. The GRA toll-free line is 0800-723-770.
